The client came to our firm after having been charged with driving on a suspended license. The young man in his 20's had gotten into trouble with the law when he was a juvenile and the judge imposed a driver's license suspension. He never resolved the underlying issue and now he was facing a criminal charge as an adult.
After hiring we contacted the state attorney's office in Hillsborough County. The charge he hired us for was based out of Orange, but the underlying suspension was based out of Tampa. The State Attorney assigned to the old juvenile case was shocked the license was still suspended. The suspension was set to last for 12 months, she did not object to the court lifting the suspension.
We submitted the paperwork for the judge to review, he denied our motion. As it turns out, years prior the judge ordered our then juvenile to complete a few aspiration actions to better his life. The client understood those to be voluntary and had since long forgotten about the requirements.
The process of identifying the problem and getting the case before the Tampa judge took a few months. Now we were running out of time in Orange County case - the judge wasn't going to grant us any additional time. However, during a review of the file I discovered the State failed to disclose a key piece of evidence. This was just what I needed to get the case extended.
The case was extended, the client satisfied all the requirements from the Tampa Judge and the suspension was lifted.
We walked into court on the morning of trial with a valid license. Ultimately, our efforts led to the State entered a nolle prosequi in the case. This dismissal effectively resolved the underlying issue that had caused the driver's license suspension.
